ORDER
The allegation in this case is that on 14.09.2021 when the defacto complainant went to the TASMAC shop to consume liquor, the accused who was also present there, asked the defacto complainant to purchase liquor for him. When the defacto complainant replied that he did not even know who the accused was, the accused is said to have abused the defacto complainant in filthy language.

2. On the strength of the said allegation, a case in Cr.No.768 of 2021 was registered on 14.09.2021 for the offence under Section 294(b) of IPC and a final report was also filed on the same day. However, after filing of the final report, the accused has remained ellusive and summons has not yet been served. The respondent police submitted that inspite of their best efforts, they are not in a position to trace out the accused.
3. Considering the nature of allegations, even if the summons is served on the future date, the continuation of the proceedings will impinge upon the right to speedy trial of the accused.
4. In view thereof, this is a fit case for exercise of power under Section 482 of Cr.P.C., and accordingly STC.No.1444 of 2021 shall stands quashed and the Suo Motu Transfer Case stands allowed. 22.08.2025 gsk electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
