The petitioner is the HR Manager of Best Money Gold. The respondent police has summoned him under Section 160 of Cr.P.C., to 1/4

appear on 13.10.2023 with details regarding transaction held between 01.01.2019 to 05.10.2023 particularly of one Rahamadullah @ Mohammed Shaffan, who is the accused in CCB Crime No.224 of 2023 under Sections 406 & 420 IPC.

This Criminal Original Petition is filed alleging that by causing summon under Section 160 Cr.P.C., the police has harassing the petitioner and therefore, not to harass.

On reading the papers and on hearing the learned Government Advocate (Crl.Side), the case under Section 420 is in force and in this connection certain particulars were required from Best Money Gold for which summon dated 09.10.2023 under Section 160 Cr.P.C., has been caused to the petitioner. If the petitioner is not in possession of the documents required, being an employee of the Best Money Gold, he has to get it from other authorized person who has custody of those documents and produce to the Investigating Officer for investigation. Just causing the summon as per the law by the respondent police cannot be presumed as harassment. If petitioner is in possession, then he has to produce the 2/4

documents or authorize his representative to produce the documents. 4.

With this observation, this Criminal Original Petition is disposed of.
