Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the second respondent to survey and measure the property in S.No.28/2A1, Thiruchitambaram Village, Vanur Taluk, Villupuram District, as per the notice dated 20.07.2023, issued by the first respondent in Na.Ka.A3/C.Pa.No.- 62/2023. O R D E R

The petitioner herein seeks a direction to the second respondent to survey the property situated in S.No.28/2A1, Thiruchitambaram Village, Vanur Taluk, Villupuram District, as per the notice dated 20.07.2023, issued by the Revenue Divisional Officer in his proceedings in Na.Ka.A3/C.Pa.No.- 62/2023.

2. By consent of both the learned counsel appearing for the petitioner as well as respondents, this writ petition is disposed of at the admission stage itself.

3. It is the case of the petitioner that he submitted a representation before the Revenue Divisional Officer seeking cancellation of patta issued in the name of one Jayamoorthy, S/o Krishnapillai. Based on the representation submitted by the petitioner, the Revenue Divisional Officer in his memo dated 20.07.2023 directed the second respondent to survey the property in survey No.28/2A1 and submit a report. The second respondent has not conducted any survey of the property as per the direction issued by the Revenue Divisional 2/5

Officer. Therefore, the petitioner is before this Court.

Mr. G.Krishnaraja, learned Additional Government Pleader, who takes notice for the respondents would submit that the second respondent will survey the property as per the direction issued by the Revenue Divisional Officer in his memo dated 20.07.2023 and file a report within a time to be stipulated by this Court.

In view of the above submission made by the learned Additional Government Pleader, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the second respondent to survey the property situated in survey no. 28/2A1, Thiruchitambaram Village, Vanur Taluk, Villupuram District as per the direction issued by the Revenue Divisional Officer in his proceedings in Na.Ka.A3/C.Pa.No. 62/2023, dated 20.07.2023 and file a report, after issuing notice to the petitioner and other interested parties including Jayamoorthy, S/o Krishnapillai, whose name was mentioned in the memo issued by the Revenue Divisional Officer, within a period of eight weeks from the date of receipt of a copy of this order. 3/5

6. With the above direction, this Writ Petition is disposed of. No costs.
