THE HIGH COURT OF JUD ICATURE AT MADRAS DATED: 01.11.2023
CORAM:
THE HONOURABLE MR.JUSTICE R.SUBRAMANIAN AND THE HONOURABLE MR.JUSTICE N.SENTHILKUMAR and C.M.P.No.24783 of 2023 Sundarrajan ...Appellant Vs.
Mathiyalagi
...Respondent
Prayer: Civil Miscellaneous Appeal filed under Section 19 of the Family Courts Act, 1984 against the fair and decreetal order passed by the learned Family Court Judge, Ariyalur in I.A.No.02 of 2023 in FCOP.No.75 of 2023 dated 14.08.2023.
For Appellant : Mr.S.Parthasarathy
J U D G M E N T
(Judgment of the Court was made by R.SUBRAMANIAN, J.) Challenge in the appeal is to the order of the Family Court, granting interim maintenance at Rs.7,000/- per month for the wife, pending 1/4
disposal of F.C.O.P.No.75 of 2023 filed by the husband on the ground of cruelty.
2.Admittedly, the husband is earning a sum of Rs.73,548/- and his take home pay is about Rs.43,198/-. A sum of Rs.6,326/- towards maintenance of the children is also included in the deductions to his salary therefore, his take home salary is Rs.43,198/-. 3.In the light of the above, we do not think, award of Rs.7,000/- per month as maintenance to the wife is said to be unreasonable. Hence, this Civil Miscellaneous Appeal is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
