Despite the petition is for condonation of delay, the learned counsel for the respondent strictly opposes that the matter has been pending for more than a decade. Therefore, it should not be condoned.

2. Taking into consideration that the appeal has been pending before this Court for quite some time and the same is dismissed for default, I am inclined to condone the delay of 398 days in filing the petition to restore S.A.No.362 of 2013. Accordingly, this petition is ordered.
