The petitioners who were arrested and remanded to judicial custody on 02.09.2023 for the offences punishable under Section 129(b), 397 and 34 of IPC r/w Section 397 of IPC in S.C.No.46 of 2023 on the file of the file of the learned Subordinate Judge, Coonoor, connected with Crime No.03 of 2013 on the file of the respondent police, seeks bail. 2.The petitioners seek bail in S.C.No.46 of 2013, which is listed on 17.11.2023 before the learned Assistant Session Judge, Coonoor. The petitioners are A1 and A2. The offence was committed in the year 2013 and the case had to be split up against the petitioners herein. It is stated that Non-Bailable warrant had issued on 01.08.2023. The petitioner had been secured on 02.09.2023.

3.Taking into consideration that the petitioners had deliberately not appeared before the Court and also the fact that the trial had never commenced owing to one after other accused being absconding, I am not inclined to grant bail to the petitioners. Accordingly, this Criminal Original Petitions stand dismissed.
