C.M.P.No. 23522 of 2019 in C.M.A. SR. 134676 of 2019 V.M.VELUMANI, J.

This petition is filed to condone the delay of 85 days in filing the above appeal.

2.Learned counsel for the petitioners submitted that no award was passed against the 1st respondent and the award is only against the 3rd respondent. The present appeal is filed only for enhancement of the compensation and therefore, notice is not necessary for the 2nd respondent.

3.Mr.J. Chandran, learned counsel takes notice for the 3rd respondent.

4.Heard the learned counsel appearing for the petitioners as well as the 3rd respondent.

5.Though notice has been served on the 2nd respondent and his name is printed in the cause-list, there is no representation for him either in person or through counsel.

6.Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 85 days is condoned and the petition is ordered. It is also made clear that the petitioners shall not be entitled for any interest for the compensation amount enhanced, if any, in the appeal.
