ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. Page No.1 of 4

2. This occurrence happened on 15.06.2006. The defacto complainant's motorcycle bearing Registration No. TN 68 C 4459 was stolen. The three accused were brought to book. The final report was filed in the year 2016 and the same is pending. It is stated that accused No.2 has since died and the charge against him stood abated. The case was split up and C.C. No. 212 of 2025 is pending against the first accused and it has been pending at the NBW stage since the year 2016. It is submitted that the police have taken their best efforts, but despite the same, the accused has not been residing in Ariyalur and his whereabouts have been completely unknown for the past nine years. Similarly, the case against accused No.3 is also pending in C.C. No. 36 of 2017. The complainant submits that he has recovered his vehicle and does not wish to pursue the case.

3. In view of the fact that the summons/warrants have not been able to be served for the past nine years, and even if the accused are brought to book hereinafter, considering the nature of allegations, the same will impinge upon the right to a speedy trial. No useful purpose will be served in keeping the case pending.

4. Accordingly, the cases in C.C.No. 212 of 2025 & C.C.No. 36 of 2017 on the file of the Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur shall stand quashed and this Suo Motu Transfer Case stand disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
