Vs V.SIVAKUMAR [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 728 days in filing the writ appeal against the dated 06/01/2015 made WP NO.29180 of 2014 and thus render justice.(in CMP.No.2378 of 2017) Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.C.JAYAPRAKASH, GOVERNMENT COUNSEL, for the petitioner and of MR.S.S.SWAMINATHAN, Advcate on behalf of

the Respondents the court made the following order:- This petition is filed to condone the delay of 728 days in filing the writ appeal against the order dated 06.01.2015 made in W.P.No.29180 of 2014.

2. Mr.S.S.Swaminathan, learned counsel accepts notice on behalf of the respondent.

3. Heard the learned Government Counsel for the petitioners/appellants and the learned counsel for the respondent.

4. Upon hearing the submission made by the learned Counsel on both sides and on being satisfied with the reasons stated in the affidavit filed in support of the petition, the petition is allowed on condition that the petitioners/appellants shall pay a sum of Rs.2,000/- (Rupees two thousand only) to the Chief Justice Relief Fund within a period of two weeks from the date of receipt of copy of this order, failing which, the order shall stand vacated automatically without further reference to this Court.

5. The Registry is directed to number the appeal upon production of proof of payment of Rs.2,000/-, if it is otherwise in order and list the same for admission.
