.. Respondents Appeal filed under Clause 15 of the Letters Patent against the order dated 20.09.2019 passed in W.P.No.27979 of 2019 on the file of this Court.
Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari calling for the records of the 1st respondent in Na.Ka.No.17116/2019/$p,. 2.4, dated 16.09.2019 and consequential order passed by the 2nd respondent bearing Na.Ka.No.892/2019/bf 1 dated 16.09.2019 and quash the same.
For Appellant : Mr.V.Suthakar
JUDGMENT
(Delivered by The Hon'ble Chief Justice) Heard learned counsel for the appellant and perused the impugned judgment.
2.The appellant is aggrieved by the dismissal of his writ petition by the learned Single Judge challenging an order of transfer. The appellant is a Block Development Officer. The contention is that the transfer from one district to another is https://hcservices.ecourts.gov.in/hcservices/
not usually undertaken and therefore, it is an unusual circumstance that the appellant appears to have been transferred, for which there did not exist any virtual administrative exigency.
3.Having gone through the impugned judgment, we do not find either any established malafides or any violation of statutory rule so as to render the transfer order invalid. The learned Single Judge, therefore, rightly arrived at the conclusion, that the same did not require any interference.
4.Learned counsel, then, contends that a sympathetic consideration be made of his representation, as the transfer has been made almost more than two kms. away. It is open to the appellant to represent his cause before the first respondent, who shall consider the same and pass an appropriate order in accordance with law.
No interference is called for with the impugned judgment. The Writ Appeal is consigned to records with the aforesaid observations. No costs. Consequently, C.M.P.No.26141 of 2019 is closed.
