Heard Mr. M.Pugalendhi, Learned Counsel for Mr. B.Kumarasamy, Learned Counsel for the Petitioner and Mr. S.J.Mohamed Sathik, Learned Government Advocate who takes notice for the First and Second Respondents and Mr. B.Anand, Learned Counsel who takes notice for the Third Respondent and perused the materials placed on record, apart from the pleadings of the parties.

When it was pointed out that the Commissioner, Karamadai Municipality against whom the order has been passed, has not been made as party, Learned Counsel appearing for the Petitioner seeks permission of the Court to withdraw the Writ Petition with liberty to file fresh Writ Petition for appropriate relief by impleading necessary parties and he has made an endorsement to that effect in the court record.

In view of the same, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
