PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, to direct the respondents 1 and 2 to produce the daughter of the petitioner namely Ms.Nithyasanantha, aged 37 years, from the illegal custody of the third respondent and set her at liberty. ORDER

(Order of this Court was made by M.S.RAMESH.J,) Complaining that the petitioner's daughter namely Nithyasanantha, aged about 37 years, had gone missing, and was in the unlawful custody of the third respondent herein, this Habeas Corpus Petition has been filed.

2. The respondent police have produced both the third respondent, as well as the petitioner's daughter before us. When we interacted with the the petitioner, as well as his daughter separately, the petitioner's daughter claims that she was in a love affair with the third respondent herein and had got married him today Morning i.e on 25.08.2025 at Parthasarathy Temple, Triplicane, Chennai. She also expressed that she intends to live only with her husband / the third respondent herein.

3. When a major woman had taken a conscious decision about her place of living, this Court, in exercise of its powers under Article 226 of the

Constitution of India, will not venture to entertain the present prayer, wherein the father seeks custody of his daughter.

4. In the light of these developments, no further orders are required to the prayer sought for in the Habeas Corpus Petition. Accordingly, this Habeas Corpus Petition stands closed.
