ORDER

The complaint filed by the petitioner was dismissed for non-prosecution since the petitioner had not taken effective steps to proceed with the case. 2.The learned counsel for the petitioner would submit that though they had taken all diligent steps to proceed with the case, the learned Magistrate erroneously dismissed the complaint and if the complaint is not adjudicated on merits grave prejudice would be caused to him.

3.Heard the learned counsel for the respondent who would submit that he is willing to settle the cheque amount to the petitioner.

4.The issues raised by the petitioner requires consideration by this Court. Hence leave granted.

5.Registry is directed to number the appeal and post for admission on 19.12.2024, if it is otherwise in order. Print the name of Mr.A.Balamurugan, learned counsel for the respondent at the time of admission.
