ORDER
This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.
2. This case is registered for the alleged offence under Section 302 of IPC. The incident occurred on 03.11.1997 and totally three accused were tried in this case. Even at the time of filing of the charge sheet, as far as the accused No.2 is concerned, he is absconding and charge sheet alone was filed. The case Page No.1 of 4
was split up and the mother case against A2 and A3 was tried and A1 and A3 were acquitted. The reasons for acquitting A1 and A3 will also apply to the present accused A2. It can be seen that for the past 25 years and more, the accused remained elusive or untraceable. The existence of the accused itself is in doubt. It is submitted that the even after due attempt and even by making proclamation, the accused could not be secured. There are no other relatives or any person related to the accused are found.
3. Considering the factual matrix, the context of the case, the background of the accused that he does not have any other antecedents, the reason for his absence at the place of residence and the submission made that despite best efforts, the warrant could not be executed, it is clear that even if the accused faces trial, no useful purpose will be served by keeping the case pending. Accordingly the case in PRC.No.100004 of 2014 on the file of the Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur stands quashed and this suo motu transfer case is disposed of. 25.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal Page No.2 of 4
of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. D.BHARATHA CHAKRAVARTHY, J.
