ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. This is a serious case registered in Crime No.311 of 2000 for the offences under Sections 302, 379, 403 and 405 of IPC. The allegation is that on account of the prior enmity, when the deceased was taking her goats to the Karuvaikadu area the accused followed her and killed her by attacking with an Page No.1 of 4

Aruval. From the date of occurrence, the accused is missing in the village. He was never apprehended in the case. The investigation proceeded without apprehending the accused and absconding charge sheet is filed. The same is taken on file as PRC No.100036 of 2006 and the matter is pending for the past 25 years.

3. Today, Mr.Kumar, son of the victim is also virtually present before this Court. He submits that even to his knowledge, the said Thangarasu is not present and was never heard of. According to him the rumour is afloat that the accused Thangarasu has already died, but however there is no clinching evidence or confirming facts with reference to the same.

4. Considering the fact that the matter is pending for the past 25 years and there is no likelihood of the accused being traced in the near future and convinced by the efforts so far made by the Police and the ground situation, I am of the view that this is a fit case for exercise of powers under Section 226 of the Constitution of India to close the case with liberty to the Police to move the matter to the concerned Court or the Court to sou motu reopen also. If in any future date, any clue as to the accused is obtained or if the accused resurfaces. With the above saving clause, the PRC No.100036 of 2006 on the Page No.2 of 4

file of the Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur is treated as closed. Accordingly, this Suo Motu Transfer case is also closed. 29.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
