Prayer: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue Writ of Mandamus directing the 1st Respondent to consider the petitioner's representation dated 27.09.2023 to transfer the Investigation from Thirukalukundram Police Station to CBCID, Chengalpattu District and to provide police protection to the petitioner's family members.

Petitioner herein suspecting that, Investigating Officer has not investigated the complaint properly which is infact an attempt to murder, but investigated as Motor Accident Case is before this Court seeking change of Investigating Agency.

2. Mr.S.Udaya Kumar, learned Government Advocate (Crl. Side) submitted that, investigation revealed that, it is an attempt to commit murder and therefore necessary steps are taken by the respondent police for altering the charges under Section 307 of IPC and alteration report will be filed soon.

3. In view of the above fact, this Court is of the opinion that there 2/4

is no necessity to transfer the investigation since it appears that Investigating Officer has collected information during the course of the investigation and he is satisfied that, it is not a case of Motor Accident, but it is a case of attempt to murder. Therefore, transfer the investigation in this case will not arise.
