ORDER

The occurrence of the offence in this case is on 23.01.2019. Both the accused are said to have stolen the Lenovo cellphone. The Lenovo cellphone, which is stolen, is also recovered and is lying as a case property in the Court. The de facto complainant has not even come back to receive the same. The de facto complainant is totally untraceable. Similarly, both the accused are also not traceable and the case is still pending at the summons stage till date. It is stated that they are native of Andhra Pradesh and have gone back to their Page No.1 of 3

native state.

2. Considering the factual matrix, context of the case, the antecedents of the accused, the reason for absence from his usual place, and the submission that, despite best efforts, the summons/warrant could not be served/executed, it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, no useful purpose would be served.

3. Accordingly, the case in C.C.No.2377 of 2019 of VIII Metropolitan Magistrate Court, George Town Taluk, Chennai, stands quashed. This Suo Motu Transfer Case is disposed of.

25.08.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
