ORDER
This case is registered for alleged offences under Section 23, 25, 25(A) of the Indian Telegraph Act, 1885. The incident occurred on 27.01.2012. The mother case in C.C.No. 110 of 2013 proceeded further and resulted in an acquittal. The grounds for acquittal also apply to the present accused. The matter has been pending for the execution of the warrant. Considering the factual matrix, the context of the case, the background of the accused, the reason for his absence at his place of residence, and the submission made that, despite best efforts, the warrant could not be executed, it is clear that even if Page No.1 of 3
the accused faces trial, no useful purpose would be served.
2. Accordingly, the case in C.C.No.42 of 2024 on the file of the District Munsif Cum Judicial Magistrate, Modakurichi Taluk, Erode shall stands quashed and this Suo Motu Transfer Case stands disposed of. 26.08.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
