Prayer in W.P.No.33769 of 2025 : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondent to issue separate patta in favour of the petitioner in Survey Nos.548/3K3, 548/3J2, 548/3L, measuring total extent of 0.08.50 acres/hectares situated at Tadangam Village, Nallampalli Taluk, Dharmapuri District, within the time frame fixed by this Court.

On the last hearing date, the learned Government Advocate appearing for the respondent informed this Court that a civil suit is pending in respect of the properties, over which the reliefs have been sought for in these writ petitions by the respective petitioners. The said fact is also not disputed by the learned counsel for the petitioners.

3. The suit arises out of a partition deed, to which the respective petitioners are a party, and the property in the said suit is also the very same Page No.2 of 4

property, for which reliefs have been sought for by the respective petitioners through these writ petitions. Since a civil suit is already pending adjudication by the civil court, that too, involving the very same property and the said civil suit being a comprehensive civil suit, the question of granting reliefs to the respective petitioners at this stage in these writ petitions by this Court does not arise. If at all the petitioners are having any remedy with regard to the prayers sought for in these writ petitions, the same will have to be redressed by the respective petitioners only before the Civil Court and not through these writ petitions filed under Article 226 of Constitution of India.

4. For the foregoing reason, this Court is not inclined to grant any relief to the respective petitioners through these writ petitions. Accordingly, these writ petitions are disposed of by granting liberty to the petitioners to redress their grievance as prayed for in these writ petitions through a Civil Court.
