Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondent to consider the petitioner's on line application dated 11.07.2024 to sub divide the survey numbers 171/1B1A into S.No.171/1B1A1 for an extent of 0.15.0 Hectares (0.38 acres) out of 0.58.13 Hectares situated in Seevoor Village, Gudiyattam Taluk and issue separate patta in his name for the said lands purchased by the petitioner in a registered document No.5691/2004 dated 18.11.2004. O R D E R

The petitioner herein seeks a direction to the respondent to consider his line application dated 11.07.2024 seeking sub devision and issuance of separate patta in respect of petitioner's lands situated in survey numbers 171/1B1A into S.No.171/1B1A1, in Seevoor Village, Gudiyattam Taluk.

2. By consent of both the learned counsel appearing for the petitioner as well as respondent, this writ petition is disposed of at the admission stage itself.

3. It is the case of the petitioner that he purchased the above mentioned property along with other property under registered sale deed dated 18.11.2004. Thereafter, the petitioner applied for issuance of separate patta for the said property. The third respondent issued a separate patta to the other property in survey No.171/3C. However, as far as the property purchased by the petitioner in Survey No.171/1B1A is concerned, the respondent issued joint patta in the name of the petitioner and his vendor's legal heirs. Therefore, the 2/4

petitioner submitted an on-line application on 11.07.2024 seeking sub division and issue of separate patta and the same has not been considered till date. Therefore, the petitioner is before this Court.

4. Mr.P.Sathish, learned Additional Government Pleader, who takes notice for the respondent would submit that the on-line application of the petitioner will be considered on its own merits and appropriate orders will be passed.

In view of the above submission made by the learned Additional Government Pleader, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the respondent to consider the on-line application of the petitioner dated 11.07.2024 and pass final orders, after issuing notice to the petitioner and other interested parties, within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
