ORDER
(1) Even though there is no appearance on behalf of the petitioner herein, I am informed by the learned Government Advocate [Crl.Side] appearing for the 1st respondent that pursuant to the investigation in the FIR in Crime https://hcservices.ecourts.gov.in/hcservices/
No.373/2017, the 1st respondent police had filed a Final Report before the learned Judicial Magistrate, Gudiyatham, on 31.10.2019. The learned Magistrate had returned the Final Report since some corrections were required and after compliance, the Final Report had been again represented in the month of January 2021. The accused had been charged with the commission of the offences under Section 294-B, 323 and 307 of IPC.
(2) Since the Final Report has been filed, interference with the FIR is not advisable and is not possible.
(3) Accordingly, the Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petition is closed.
(4) The petitioners herein may answer the summons whenever it is forwarded and received by them, by the learned Judicial Magistrate, Gudiyatham.
