PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the 2 nd respondent to pay the compensation amount determined under Section 19(3) and 19(6) of Tamil Nadu Highway Act, 2001, to the petitioner as per the notice dated 28.08.2023, within the time frame fixed by this Court. ORDER
This writ petition has been filed by the petitioner seeking to direct the 2 nd respondent to pay the compensation amount determined under Section 19(3) and 19(6) of Tamil Nadu Highway Act, 2001, to the petitioner as per the notice dated 28.08.2023, within the time frame fixed by this Court. 2.Learned counsel for the petitioner would submit that though the petitioner's property was acquired by the 2 nd respondent/Highways Department, till date the compensation has not been paid to the petitioner inspite of several
representations sent by the petitioner to the 2 nd respondent. Hence, the present writ petition has been filed.
3.Learned Additional Government Pleader appearing for the respondents by referring the letter dated 28.08.2023 would submit that vide letter dated 28.08.2023, it was communicated to the petitioner and other legal heirs that the compensation was quantified to a extent of Rs.1,07,36,655.80/-. However, till date neither the petitioner nor the other legal heirs come forward to collect the award amount. However, they preferred to file the writ petition. He would further submit that the 2 nd respondent is ready and willing to disburse the award amount within a period of one week time from the date of request made by the petitioner in person.
4.Heard the learned counsel for the petitioner as well as the learned Additional Government Pleader appearing for the respondents and perused the materials available on records.
5.Considering the submissions made by either parties, this Court does not find merits in the submissions of the learned counsel for the petitioner and is not inclined to fix any time limit for disbursement of amount since the 2 nd respondent has very well communicated the petitioner regarding the quantum of compensation and to collect the same through letter dated 28.08.2023. Since the petitioner has not come forward to collect the award amount, the same remains with the 2 nd respondent. At any cost, the 2 nd respondent is ready and willing to disburse the compensation to the petitioner and hence, the petitioner is directed to approach the 2 nd respondent for disbursement of compensation and the 2 nd respondent shall disburse the compensation as quantified in the letter dated 28.08.2023, within a week as agreed.
