ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case arises out of matrimonial discard. The accused was tried for the offence under Sections 498 (A), 506 (ii) I.P.C., and 4 of Dowry Prohibition Act, in Cr.No.05 of 2005 dated 04.02.2005. Page No.1 of 3

3.Today, it is submitted on behalf of the Police that both the complainant/wife and the accused/husband remain untraceable. The case is pending from 2005 over a period of twenty years. There is no likelihood of any meaningful trial being conducted in future and it will impinge upon the right to speedy trial of the accused.

4.Accordingly, the case in C.C.No.44 of 2020 of District Munsif cum Judicial Magistrate Court, Vikravandi, Vikravandi Taluk, Villupuram, stands quashed. This Suo Motu Transfer Case is disposed of. 26.08.2025 ep electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
