ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.835 of 2018 dated 03.09.2018 for the alleged offences under Sections 279 and 338 I.P.C., based on the allegation that the accused drove the car in a rush and negligent manner and hit the complainant's mother-in-law. No case has been filed by the victim for Page No.1 of 4

any compensation.

3.Even though the case is taken on file as S.T.C.No.237 of 2020, the case is pending for the past four years under the caption 'Fresh summons'. It is reported that the accused is not available in the said address. Even if summons are served on a future date and the accused is brought forward, it can be seen that by sheer efflux of time, the right to speedy trial of the accused shall stand impinged in view of the nature of the allegations. No useful purpose will be served in keeping the case pending. 4.Accordingly, the case in S.T.C.No.237 of 2020 of Judicial Magistrate Court No.I, Villupuram Taluk, Villupuram, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
