ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The allegation in this case is that on 17.08.2019, the accused was arrested for having possession of ten numbers of railway Pandrol Clips of total value of Rs.1000/-. As such a case was registered in Cr.No.03 of 2019 under Section 3 (a) of RP (UP) Act, 1966. He was also arrested and was in custody Page No.1 of 3
for a period of sixty days. Thereafter, he was enlarged in bail. Eventhough, the chargesheet is filed, the matter is pending in the fresh summon stage. 3.In view of the time lag and considering the background of the offence and the period of custody the accused has already undergone, even if the accused is brought for trial in future, the same in the context would impinge upon his right to a speedy trial and no useful purpose would be served. 4.Accordingly, the case in C.C.No.3451 of 2019 of XI Metropolitan Magistrate Court, Saidapet Taluk, Chennai, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
