2.Heard the learned counsel for the petitioner and the learned counsel for 1st respondent and perused the records.

3.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 125 days is condoned.

4.The learned counsel for the appellant is directed to serve the copies on the learned counsel for the 1st respondent.

5.The name of the counsel for the 1st respondent shall be printed in the cause list at the time of admission.
