Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the entire records relating to the impugned order passed by the respondent in his proceedings No.Rc.PA2/9669/2010, dated 09.12.2010 and quash the same and consequently, direct the respondent to reinstate the petitioner into service along with backwages, attendant benefits and other monetary benefits to the petitioner.

ORDER
This Writ petition has been filed seeking quashment of the order passed by the respondent in his proceedings No.Rc.PA/9669/2010 dated 09.12.2010 and to consequently, direct the respondent to reinstate the petitioner into service along with backwages, attendant benefits and other monetary benefits.
2. Mr.K.Surendran, learned Additional Government Pleader takes notice on behalf of the respondent. In view of the consent expressed by the learned counsel on either side, this Writ petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that, on 14.01.1995, he joined the service as Rural Welfare Officer Grade - I in Nagapattinam District, Sembanarkoil Panchayat Union. After several transfers and promotions, when the petitioner was working as an Assistant in Small Savings Department at Collectorate, Vellore, he was falsely implicated in the case of Vigilance and Anti-corruption for the alleged receipt of Rs.4,000/-. 2/7
Subsequently, the petitioner was suspended from service, vide impugned proceedings dated 09.12.2010, without concluding the departmental proceedings initiated against him. While so, though the petitioner was arrested on 08.12.2010 in connection with Cr.No.15 of 2010 filed by the Inspector, Vigilance & Anti-Corruption Department, Vellore under Sections 7 and 13(2) r/w 13(1)(d) of the Prevention of Corruption Act, 1988 and was facing trial in Special CC.No.4 of 2013 before the Chief Judicial Magistrate, Vellore, however, he was subsequently acquitted from all the charges levelled against him, by the trial court on 14.10.2024. Pursuant to the same, the petitioner made representations dated 14.11.2024 and 16.04.2025 before the respondent seeking to permit him to join duty. However, till date, no orders have been passed on the said representations. Hence, the petitioner has come up with this Writ petition, challenging the order of suspension dated 09.12.2010 passed by the respondent.
4. Heard learned counsel on either side and perused the materials available on record.

Though very many grounds have been raised by the learned counsel on either side, at the time of arguments, the learned counsel for the petitioner restricted the prayer and submitted that, it would suffice, if this Court issues a direction to the respondent to consider the petitioner's representations dated 14.11.2024 and 16.04.2025 in the light of G.O.Ms.No.81, Human Resources Management (N) Department dated 04.08.2022 and also the order of acquittal dated 14.10.2024 passed in Special CC.No.4 of 2013 and pass appropriate orders within the time stipulated by this Court.
6. Learned Additional Government Pleader appearing on behalf of the respondent did not raise any serious objection for the limited request made by the learned counsel for the petitioner.
7. In view of the above, this Court, without expressing any opinion on the merits of the case and without interfering with the order impugned in this Writ petition, directs the respondent to consider the petitioner's representations dated 14.11.2024 and 16.04.2025 in terms of 4/7
G.O.(Ms).No.81, Human Resources Management (N) Department dated 04.08.2022 and pass appropriate orders on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order, after hearing the petitioner and aggrieved persons, if any.
8. Accordingly, this Writ petition stands disposed of with the aforesaid directions. No costs. Consequently, the connected Miscellaneous petition is closed.
