Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the Order passed by the First Respondent in R.C.No.B1/073777/2001 dated 6.07.2001 insofar as the Petitioners are concerned and quash the same and direct the First Respondent to draw seniority list on the basis of the order passed by the First Respondent in R.C.No.B1/177/90 dated 15.12.1993 and further promote the Petitioners as Assistant Registrars on that basis.

ORDER

The Writ Petition has been filed challenging the Seniority List issued by the First Respondent vide Proceedings in R.C.No.B1/073777/2001 dated 6.07.2001 .

When the matter is taken up for hearing today, the learned counsel appearing for the Petitioners submits that the Petitioners have been given promotion to the higher post, after filing of the Writ Petition, but still some of them are still in service and hence, the question of seniority is the higher post may remain for consideration and in that event, liberty should be reserved for them to agitate their rights in accordance with law. He has also made an endorsement to that effect in the Court records.

In the aforesaid circumstances, the Writ Petition is dismissed as infructuous with an observation that it would not preclude the petitioners from pursuing remedy in accordance with law if they are still aggrieved by the placement of seniority in the higher post. No costs.
