This Civil Miscellaneous Petition has been filed seeking to condone the delay of 125 days in filing C.M.A.SR.No.130343 of 2022.

2.The learned counsel for the 1st respondent submitted that the 1st respondent is the wife of the 2nd respondent and that the 1st respondent died. The learned counsel submitted that he will file a separate vakalat for the 2nd respondent.

3.Heard the learned counsel for the petitioner and the learned counsel for 1st respondent and perused the records.

4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 125 days is condoned.

5.The learned counsel for the appellant is directed to serve the copies on the learned counsel for the 1st respondent.

6.The name of the counsel for the 1st respondent shall be printed in the cause list at the time of admission.
