ORDER

This Criminal Original Petition has been filed to direct the respondent Police to register a case on the complaint of the petitioner dated 29.10.2022.

2. Heard the learned counsel for the petitioner and the learned

Government Advocate (Crl. Side) appearing for the respondent.

3. The learned counsel for the petitioner submitted that the petitioner has given a complaint against Poorasamy and Shankar on the allegation that they have trespassed into his lands and cut the Eucalyptus trees grown over there.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that on the complaint given by the petitioner, current paper enquiry has been initiated in CSR No.1055 of 2022 and the matter has been closed as "civil in nature" on 15.11.2022.

5. However the learned counsel for the petitioner submitted that there is no property dispute between himself and the opposite parties and the civil dispute is only between the lessor of the petitioner and the said Poorasamy and Shankar.

6. Since the respondent has stated that the enquiry has been

completed and it has been closed, it is appropriate for the respondent Police to furnish the copy of the closure report to the petitioner. It is needless to mention that if the petitioner is not satisfied with the enquiry conducted by the Police in CSR No.1055 of 2022, he is at liberty to work out his remedy either under Section 156 (3) of Cr.P.C. or under Section 200 of Cr.P.C., if so advised.

7. With the above observation, this Criminal Original petition is disposed of.
