The petitioner herein is the complainant in Cr.No.244 of 2022 dated 16.10.2022. The accused is the husband of the complainant. The trial of the case is pending in C.C.No.78 of 2023 on the file of the learned Judicial Magistrate, Vaniyampadi. The present petition is filed for direction to expedite the trial.

2. The learned Government Advocate (Crl.Side) appearing for the respondent police submits that out of eight witnesses, prosecution has so far examined four witnesses and the matter is adjourned for further witnesses. The accused is not appearing since 20.09.2023. The petition filed to dispense with his appearance allowed by the trial Court and the trial is in progress. The matter is adjourned for examination of L.W.5 and L.W.6 on 18.11.2024 and on that date, the listed witnesses will be produced for examination. He further submits that the remaining witnesses will be marshalled within a period of two months and complete the trial.

3. In view of the above undertaking given by the prosecution, this 2/4

Criminal Original Petition is disposed of with direction to the respondent police to marshall the witness and complete the examination of prosecution witness within a period of two months and thereafter, the learned Judicial Magistrate shall proceed further and complete the trial preferably within a period of four months from the date of completion of examination of witnesses on either side.
