Respondent Prayer: Transfer Civil Miscellaneous Petition filed under Section 24 of the Civil Procedure Code, to order withdrawal of the HMOP No.153 of 2019 from the file of the Sub Court, Tiruvannamalai and transfer the same to the file of III Additional Sub Court, Madurai.

ORDER

Learned counsel for the petitioner submitted that the respondent has been served about the pendency of the proceedings before this court. There is no representation for the respondent. As the respondent has not shown any interest to represent the matter before this court even though his name is printed in the cause list, H.M.O.P. No.153 of 2019 pending on the file of Sub Court, Tiruvannamalai is withdrawn and transferred to the file of III Additional Sub Court, Madurai. The learned III Additional Sub Judge, Madurai, is expected to conclude the trial, as expeditiously as possible, without adjourning the matter beyond thirty working days at any point of time, in order to bring the issue to a logical end. Sub Court, Tiruvannamalai is directed to transmit all the papers pertaining to H.M.O.P. No.153 of 2019 to the III Additional Sub Court, Madurai, immediately after receipt of a copy of this order.
