Learned counsel for the applicant has filed an affidavit of service by enclosing the track consignment report. The said track consignment report evidencing receipt of notice by the respondents. Learned counsel appearing for the original respondents, who passed away, submits that he has not been provided instructions with regard to the proposed respondents.

The applicant/petitioner has filed this application to condone the delay of 5193 days in filing the application to set aside the abatement. In the affidavit in support of this application, the applicant has stated that the delay occurred on account of the COVID 19 pandemic and the change of counsel because the earlier counsel decided to re-locate outside the country. In these circumstances, the delay, though length, is condoned. List the other applications on 08.03.2023.
