Prayer : Writ Petition filed under Article 226 of Constitution of India for issuance of a Writ of Mandamus directing the respondents 1 to 4 to consider the representation of the petitioner dated 30.07.2024 within a time frame fixed by this Court.

The present Writ Petition has been filed by the petitioner for issuance of a Writ of Mandamus directing the respondents 1 to 4 to consider the representation of the petitioner dated 30.07.2024.

According to the petitioner, he is working as a shift engineer in Government Modern Rice Mill / 4th respondent since 21.05.2007 and through the 1st respondent, all deductions including provident fund have been deducted from the petitioner's salary till date. Though in SR Register, Date of Birth has been correctly mentioned as 14.07.1975, the 1st respondent, made a wrong entry of the date of birth of the petitioner as 21.05.2007 instead of 14.07.1975 in the Provident Fund Account details, on account of which, the petitioner is unable to link the Aadhar number 2/5

with the provident fund account. Inspite of representation of the petitioner dated 30.07.2024 being received by the respondents to take appropriate steps to rectify the error in the provident fund account to change the date of birth as 14.04.1975, the same has not been considered, hence this petition.

3. The learned Additional Government Pleader appearing for the respondents fairly submitted that the wrong entry, if any, would be rectified upon verifying the documents, as expeditiously as possible.

The petitioner has filed his Identity card issued by the 4th respondent, on going through the same, it is seen that the date of birth of the petitioner is clearly mentioned as 14.04.1975, however, in the P.F.Account of the petitioner alone it has been mentioned as 25.04.2007. On account of the same, the petitioner has submitted a representation to the authorities, however, the same has not been considered.

5. In view of the above, the respondents 1 to 4 are directed to rectify the mistake committed by them in the date of birth of the petitioner in P.F.Account after verifying with the necessary documents in 3/5

accordance with law as expeditiously as possible, preferably within four weeks. Accordingly, the Writ Petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs. 07.11.2024 Index : Yes/No Internet: Yes / No Speaking order : Yes/No ssd To
