ORDER

This Civil Revision Petition has been filed to challenging the I.A.No.1 of 2024 in O.P.No.3449 of 2023 dated 18.07.2024 on the file of the learned Principal Family Court at Chennai.

2. The Revision Petitioner/husband has filed petition seeking divorce on the ground of cruelty and mental illness. He also filed I.A.No.1 of 2024 before the learned Principal Family Court at Chennai to direct the respondent wife to submit herself before the Medical Board in Psychiatry Department at Rajiv Gandi General Hospital,Chennai or Kilpauk Mental Hospital, Chennai to prove the physical and mental illness. That application was contested by the respondent, however she is ready to appear before the Medical Board. Inspite of that, the trial Court has dismissed the said petition. Aggrieved by the said order, the present application is filed.

3. Though notice was served on the respondent, none appeared.

4. It is seen that the revision petitioner has filed divorce petition on the ground of cruelty and mental illness. He also filed application seeking direction to the respondent wife to submit herself before the Medical Board, but it was not considered. But on perusal of records, it revealed that, the learned Judge has observed that the respondent herself is ready to appear before the Medical Board and inspite of that, the said application was dismissed. To prove his defence, the revision petitioner sought for such direction before the Court and even for that, the respondent wife was also inclined. However, he was not given opportunity to prove the grounds/claim raised by the revision petitioner. Therefore, this Court setasides the order passed by the learned Principal Family

Court at Chennai in I.A.No.01 of 2024 in O.P.No.3449 of 2023 dated 18.07.2024.

5. Accordingly, this Criminal Revision Petition is allowed and the connected miscellaneous petition is closed.
