2. Heard. Though notice was served on the respondent and his name appears in the cause list, he has not chosen to appear before this Court either in person or through a pleader.

3. Satisfied with the reasons stated in the affidavit in support of the petition, this petition is allowed and the delay of 404 days in filing the above appeal, is condoned.

Registry is directed to number the appeal, if it is otherwise in order and post 'for admission' in due course.
