This application is filed to grant leave to record the evidence of the third party witness namely, Mr.G.Durai, who is the son of the 1st attesting witness to the Will dated 22.10.1991 executed by the testator Vellai Maistry.

smv 2.According to the applicant, the Original Petition has been filed for grant of Letters of Administration in respect of the Will executed by Vellai Maistry. Since both the attesting witnesses are no more, the applicant want to examine above said witness, who is well acquainted with the signature of the 1st attesting witness and the testator. Therefore, this application has been filed by the applicant.

3.There is no representation for the respondents. 4.Considering the reasons stated in the affidavit and the facts and circumstances of the case and in order to prove the Will in accordance with law, this application is allowed.
