ORDER

The applicant/plaintiff is having the benefit of interim injunction order in O.A.No.762 of 2024 in C.S.(Comm Div) No.195 of 2024 from 18.10.2024 onwards. Till date, counter has not been filed by the 1/5

respondents. No useful purpose will be served if this application is allowed to be kept pending. The applicant/plaintiff has already made out a prima facie case for the grant of interim injunction as prayed for in O.A.No.762 of 2024. Being a commercial suit, the interlocutory applications cannot be kept pending for a long period of time.

2. Accordingly, the interim injunction granted by this Court on 18.10.2024 in O.A.No.762 of 2024 in C.S.(Comm Div) No.195 of 2024 is made absolute and O.A.No.762 of 2024 in C.S.(Comm Div) No.195 of 2024 is allowed as prayed for without prejudice to the rights and contentions of the respondent/defendant to raise all objections in the main suit.

3. Learned counsel for the defendant seeks time to represent the written statement, which has been returned by the Registry.

4. Registry is directed to submit a report before this Court as to whether the written statement is filed within the statutory period on the next hearing date.
