ORDER
This petition has been filed to permit the petitioner to leave India and join as Cyber Security Architect, an Employee in the Punch Powertrain NV Company situated at Ondernemerslaan 5429 - Poort Sint-Truinden, 3800 Sint - Truiden, at Belgium.
2. The learned counsel for the petitioner submits that the petitioner was granted anticipatory bail in Crl.O.P.No.23042 of 2024 vide order dated 24.09.2024, subject to the condition that " the petitioner shall not leave India without the previous permission of the Court". This condition has prevented the petitioner from obtaining a visa and securing residence permits. Consequently, the petitioner filed Crl.M.P.No.9669 of 2025 seeking permission to leave India from 01.06.2025 to 01.06.2026, but the same was dismissed owing to insufficient particulars furnished by the petitioner with a liberty to file a better petition by furnishing all necessary and relevant details. The petitioner has now been selected as a Cyber Security Architect with Punch Powertrain NV Company in Belgium and is required to join the company on 09.12.2025. In view of this development, the petitioner seeks permission from this Court to leave India to take up the said employment opportunity.
3. The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the investigation is at a crucial stage and strongly
opposes the petitioner's request for permission to leave India, apprehending that the petitioner's absence may potentially hamper the progress of the investigation.
4. Considering the fact and circumstances of the case, the opposition raised by the learned Government Advocate and the crucial stage of investigation, this Court is not inclined to grant the relief sought for by the petitioner.
5. Accordingly, this Criminal Miscellaneous Petition is dismissed. However, liberty is granted to the petitioner to file a better petition by furnishing all necessary and relevant details.
