After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT The appellant- Sudalaimuthu has filed M.C.O.P.No.989 of 2020 claiming award amount of Rs.30,00,000/- with interest and cost. The claims Tribunal awarded a sum of Rs.3,65,400/- with interest and cost. Aggrieved by the above amount awarded by the Tribunal, the appellant filed an appeal before the Hon'ble High Court. 2.Both the parties having initiated negotiation successfully arrived at a settlement of all the issues arisen in this case as follows: 3.The second respondent- Bajaj Allianz General Insurance Co. Ltd. has agreed to pay a sum of Rs.

2,75,000/- (Rupees Two lakhs Seventy Five thousand only) in full quit, in addition to a sum of Rs.3,65,400/- awarded by the Tribunal and paid by the second respondent to the appellant herein. The appellant has agreed to receive the said amount in full quit within a period of four weeks from the date of receipt of order passed by the National Lok Adalat.

4.Both the parties made a formal request to the National Lok Adalat to pass an award in terms of the above settlement. 5.As a result, the award is passed hereby in terms of the above compromise arrived at between the parties directing the second 2/5

respondent-Insurance company to pay a sum of Rs.2,75,000/- (Rupees Two lakhs Seventy Five thousand only) in full quit, in addition to a sum of Rs.3,65,400/- (Rupees Three lakhs Sixty Five thousand and Four hundred only) awarded by the Tribunal and paid already by the second respondent to the appellant, within a period of four weeks from the date of receipt of a copy of order passed by the National Lok Adalat. 6.Consequently, the Civil Miscellaneous Appeal stands disposed of. Counsel for Respondents This Lok Adalat award is passed in terms of the above settlement. The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
