This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Certiorari, to call for the records pertaining to the second class legal Heir certificate vide document No. PA. Mu. A/2/2729/2023, dated 16.00.2023 issued by the 4th respondent and quash the same as illegal arbitrary and non est in law.

ORDER

The Writ Petition has been filed seeking to quash the second class legal Heir certificate vide document No. PA. Mu. A/2/2729/2023, dated 16.00.2023 issued by the 4th respondent.

2. It is the case of the petitioner that second respondent has issued second class legal certificate in favour of the private respondents. According to the petitioner, the private respondents have created bogus certificate and obtained legal heir certificate of Padmavathi ammal who was the owner of the subject land. In the year 1979, the said Padmavathy sold the said property to the petitioner by way of oral agreement and the petitioner is in continuous possession and enjoyment of the said property. On the strength of the aforesaid bogus certificate, the 5 th respondent executed a release deed in favour of her daughter devaki on 03.01.2024. Hence, the petitioner made a representation to the first respondent requesting to initiate legal action against the private respondents herein and the VAO, who have fraudulently procured the said false

second class legal heir certificate with the intention of unlawfully grabbing the petitioner's property and no action is taken so far. Hence, the petitioner has filed the present writ petition seeking to quash the legal heir certificate.

The learned counsel for the petitioner submitted that the impugned certificate wrongfully includes the names of persons who have no blood relation or relation or lawful succession rights to Padmavathi, thereby violating the provisions of the applicable succession laws and the Government guidelines governing the issuance of legal heir certificates. The respondents 5 & 6 deliberately suppressed the material fact that the property stands in the name of Padmavathi, the first wife of Sunthar Reddiyar and not in the name of their alleged predecessor.

4. Heard the learned counsel for the petitioner as well as the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

5. This Court perused the entire records. On perusal of the same, it is made clear that the claim made by the petitioner is disputed question of fact, which cannot be decided by this Court under Article 226 of the Constitution of India and the same has to be decided only by the competent civil forum. The petitioner has to approach the civil Court. Without doing so, filing the present petition is not

sustainable and therefore, this Court is not inclined to interfere with the impugned notice.

6. In view of the above, this Court, without rendering any opinion on the merits of the case, permits the petitioner to approach the competent Civil Court and canvass all the points before the said Court.
