The petitioners, who wre arrested and remanded to judicial custody on 02.08.2025 for the alleged offences punishable under Sections 296(b),126(2),311 and 109 of BNS, in Crime No.293 of 2025, on the file of respondent police, seek bail.

2. The case of the prosecution is that the petitioners along with other accused threatened the defacto complainant at knife point and snatched cash and watch from him and also assaulted him. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that the petitioner are innocent and they have been falsely implicated in this case. He also submitted that the petitioners are no way connected with the alleged offence, however, he is suffering incarceration from 02.08.2025 . He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioners. 4.The learned Government Advocate (Crl.Side) appearing for the respondent police, while opposing for grant of bail to the petitioners, reiterate the prosecution case. He further submitted that the investigation is almost completed

5. Taking into consideration the facts and submissions made by both counsels, and the investigation is almost completed, and also considering the period of incarceration undergone by the petitioners, this court is inclined to 2/5

grant bail to the petitioner with certain conditions.

Accordingly, the petitioners are ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each, in which one surety must be a blood surety for a like sum to the satisfaction of the learned Judicial Magistrate, Katpadi and on further conditions that:

(a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; (b) the petitioners shall report before the respondent police on every alternative days at 10.30 a.m. for a period of three months (c) the petitioners shall not tamper with evidence or witness either during investigation or trial;

(d) the petitioners shall not abscond either during investigation or trial;

(e) on breach of any of the aforesaid conditions, the Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; 3/5

(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
