O R D E R

The petitioner herein seeks a direction to the respondents 1 & 2 to take action based on his representation dated 22.08.2024 seeking to register / file the sale certificate issued by the Recovery Officer DRT-III, Chennai, within stipulated time fixed by this Court.

2. By consent of both the learned counsel appearing for the petitioner as well as respondents, this writ petition is disposed of at the admission stage itself.

3. It is the case of the petitioner that he was a successful bidder in the auction conducted by the Recovery Officer of DRT - III, Chennai and a sale certificate was issued in his favour in respect of the property described in his representation dated 22.08.2024. It is further stated that the copy of the sale certificate was forwarded to the second respondent with a covering letter for filing in Book No.1 and the same has not been considered. Therefore, the petitioner submitted a representation dated 22.08.2024 before the second respondent seeking to file the sale certificate issued by the Recovery Officer 2/4

DRT-III, Chennai and the same has not been considered till date. Therefore, this petitioner is before this Court.

4. Mr.P.Harish, learned Government Advocate, who takes notice for the respondents would submit that the representation of the petitioner will be considered on its own merits and appropriate orders will be passed.

5. In view of the above submission made by the learned Government Advocate, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the second respondent to consider the representation of the petitioner dated 22.08.2024 and pass final orders, after issuing notice to the petitioner and other interested parties, within a period of two weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 25.10.2024 Index : Yes/No Internet : Yes/No Speaking Order/Non-Speaking Order 3/4
