Respondent Prayer: Transfer Civil Miscellaneous Petition filed under Section 24 of the Civil Procedure Code, to withdraw F.C.O.P. No.238 of 2019 from the file of Family Court at Erode and transfer the same to the Sub Court, Sankari, to be tried along with H.M.O.P. No.87 of 2019.

ORDER

Learned counsel for the petitioner submitted that the respondent has been served about the pendency of the proceedings before this court. There is no representation for the respondent. As the respondent has not shown any interest to represent the matter before this court even though his name is printed in the cause list, F.C.O.P. No.238 of 2019 pending on the file of Family Court at Erode is withdrawn and transferred to Sub Court, Sankari, to be tried along with H.M.O.P. No.87 of 2019. The learned Subordinate Judge, Sankari, is expected to conclude the trial in both the cases, as expeditiously as possible, without adjourning the matter beyond thirty working days at any point of time, in order to bring the issue to a logical end.
