O R D E R

This writ petition has been filed challenging the order passed by the Industrial Tribunal, Chennai in Approval Petition No.34 of 2012 dated 07.02.2023, wherein the respondent herein has filed an Approval Petition to grant approval of the dismissal order passed against the petitioner by the respondent in its disciplinary proceedings. The Industrial Tribunal, Chennai allowed the Approval Petition by order dated 07.02.2023, challenging the same the writ petition has been filed.

2. After elaborate arguments, the learned counsel for the petitioner considering the limited scope in the Approval Petition would submit that without prejudice to the rights of the petitioner to challenge the dismissal order by raising an Industrial Dispute this writ petition may be disposed of and also requested to pass order to exclude the period of limitation for the pendency of the writ petition under Section 14 of the Limitation Act.

3. Considering the above submission, this Court is inclined to dispose of the writ petition with liberty to the petitioner to challenge the dismissal order in

the manner known to law before the appropriate forum and the petitioner is also entitled to the benefit of Section 14 of the Limitation Act for the pendency of this writ petition.
