O R D E R
The State had filed this miscellaneous petition seeking further period of three months time to complete the investigation and file a final report.
2.The petitioner/accused, who was arrested in a trap case and suspended from the service, had filed the above criminal original petition in Crl.O.P.No.11860 of 2025 seeking to complete the investigation and to file a final report. This Court, by the order dated 22.04.2025, recorded the submission of learned Government Advocate that the investigation is at the final stage and charge sheet would be filed within a period of four months. This four months period have passed by, still final report not filed. 2/4
3.The learned counsel for the petitioner submitted that due to the pendency of the above case, the petitioner's terminal benefits are withheld and she has been put to untold misery and sufferings. 4.The learned Additional Public Prosecutor submitted that in this case investigation completed, charge sheet along with statement and documents submitted to the appointing authority, seeking sanction under Section 19 of the Prevention of Corruption Act. Once the sanction is obtained, final report would be filed before the appropriate Court. 5.Finding that in this case investigation completed, charge sheet made ready and awaiting sanction for prosecution, the appointing authority, namely, Tahsildar is directed to process the request for sanction and pass appropriate orders within a period of three months. This three months period is only an outer limit.
