O R D E R

The State had filed this miscellaneous petition seeking further period of six months time to complete the investigation and file the final report in Crime No.7 of 2024.

2.Earlier the learned Government Advocate made a submission in Crl.O.P.No.11876 of 2025 on the premise that A2 is also a public servant. Hence, for obtaining sanction under Section 19 of the Prevention of Corruption Act sought four months time and this Court by the order dated 23.04.2025 granted four months time. Now during investigation it is found that A1 is the public servant and A2 is employed as a Watchman on contract basis and not a public servant. To collect documents and examine witnesses to confirm that A2 in this case is not a public servant, the learned Additional Public Prosecutor needs one month's time. Thereafter, final report would be 2/4

sent to the appointing authority to get sanction under Section 19 of the Prevention of Corruption Act for A1, for which, he seeks four months time. 3.In view of the above, two months time is granted to complete the investigation and thereafter final report along with statement and documents to be submitted to the sanctioning authority. The sanctioning authority shall process the request for sanction and pass appropriate orders within a period of three months. In total, five months period is granted to complete the investigation and file a final report. This five months period is only an outer limit.

4.With the above direction, this Criminal Miscellaneous Petition is ordered.
