Crl.O.P.Nos.24258 and 24269 of 2023 C.V.KARTHIKEYAN,J.

The first accused has filed Crl.OP.No.24258 of 2023 and the petitioners/A2 to A8 have filed Crl.OP.No.24269 of 2023. Both applications have been filed in Cr.No.38 of 2023 registered under Sections 498A, 494, 506(ii) of IPC.

2. The petitioner/A1 in Crl.OP.No.24258 of 2023 is the husband of the defacto complainant. The fifth petitioner/A6 in Crl.OP.No.24269 of 2023 is said to be the second wife of the first accused.

3. The learned counsel for the petitioners stated that they had only undergone an engagement ceremony. The marriage of the first accused with the defacto complainant took place on 22.01.2018. Thereafter, either engagement or marriage between the sixth accused and the first accused had taken place on 17.09.2023. The said fact is also 1/3

stated by the learned counsel for the petitioners themselves. Once it is established that the first accused had deliberately entered into subsequent relationship with another lady when the first marriage was still subsisting whatever be the reason, investigation will have to be conducted. I am not inclined to grant anticipatory bail to any of the accused.

4. However, this Court directs the respondent police to take the petitioner in Crl.OP.No.24258 of 2023 /A1 into custody and report before this Court on 03.11.2023.

5. With the above directions, these Criminal Original Petitions are dismissed.
