Appln. No.5429 of 2022 in OP. No.207 of 2013 KRISHNAN RAMASAMY,J.

This application has been filed, seeking to direct the Registry of this Court to send the records of the Arbitral Tribunal to the jurisdictional Court (i.e., the Delhi High Court) as per the liberty granted by the High Court of Delhi in O.M.P(Comm) no.108 of 2022 at the earliest.

2.This Court, vide order dated 23.02.2021 while disposing the Original Petition in O.P.No.207 of 2013, directed the Registry to return the case papers/file including the original impugned Award within ten working days from the date of receipt of the order. However, this direction has not been complied with by the Registry and withheld the papers for want of the Order of the Delhi High Court passed in OMP (Comm) No.108 of 2022 dated 25.07.2022 since the learned counsel for the applicant has not furnished the same.

3. The learned counsel for the applicant has filed a memo, dated 13.12.2022, stating that the Delhi High Court vide order, dated https://www.mhc.tn.gov.in/judis Page 1/2

dn 28.11.2022, has extended the time limit to the Registry to get the records from this Court and listed the matter on 04.05.2023 and therefore, he would submit that this application may be disposed of by directing the Registry to transmit all the case papers/file including the original impugned Award to the Delhi High Court pursuant to the order already passed this Court, dated 23.2.2021 in O.P.No.207 of 2013 and he also enclosed the order, dated 28.11.2022 in O.M.P.(Comm) No.108 of 2022 passed by the Delhi High Court.

4. The memo, dated 13.12.2022 filed by the learned counsel for the applicants is taken on record. Considering the submissions made by the learned counsel for the applicants, the Registry is directed to transmit all the case papers/records including the impugned Award as expeditiously as possible to the Delhi High Court, without any further delay.
