Ponnaya @ Pavayee (Died) v. Rakkiya Gounder

These petitions have been filed by the petitioners to set aside the abatement caused due to the death of the sole appellant Ponnaya @ Pavayee; to condone the delay of 972 days in filing the petition to bring on record the legal heirs of the deceased sole appellant and to bring on record the petitioner herein, as 2nd appellant in S.A.No.354 of 2011.

2. Heard both sides.

3.Considering the submissions made on behalf of the learned counsel for the petitioners and being satisfied with the reasons stated in the affidavit filed in support of these petitions, the delay is condoned and the petitions are allowed. Necessary amendments shall be carried out. 4.Post the second appeal on 22.08.2024.
